TERMS & CONDITIONS by THE ZENERA

 

If you purchase any The Zenera’s services you are deemed to:

(a) have read, understood and agreed to these Terms & Conditions; and

(b) understand that these Terms & Conditions are contractual in nature, have legal effect, and are not merely a warning or provided for information.

 

By accepting an invitation to become a participant, you will make Us aware of anything that may affect you being a participant, such as illness, phobias, limited swimming ability, allergies, or anything that can affect your wellbeing or safety during the event.

 

The program of the event is subject to change due to unforeseen circumstances that could include weather, damage, endangerment, cancellation by businesses, scheduling, and so on.

 

You must not participate in the program unless:

(a) you agree to take the most sensible approach to risk management whilst on the trip;

(b) you are in good health and have no medical condition that will impact your ability to participate in the program; and

(c) you are responsible and able to take care of your own safety and your own possessions whilst participating in the program.

You agree to inform Us promptly of any change in your health or well-being after booking and before the event

 

Acceptance of Risk

Some activities as part of the program may be adventurous and require physical activity and participation may be dangerous. During activities, you will be visiting places where there may be dangers and challenges greater than those present in your daily life. There is a higher degree of personal risk due to participation in the program.

All participants in this retreat agree to participate any activities at their own risk.

You agree that you have been advised of the risks associated with the activities and voluntarily chose to participate in the event fully accepting that the materialization of such risks may cause personal injury, death, material damage, or economic loss.
 

During the period of The Zenera retreat, you agree to not engage in illegal activity, or any other activity to discredit The Zenera, its members, or affiliates, including but not limited to, the use of drugs, drunken disorderly, and general misconduct. 

We strongly recommend that you obtain travel insurance before joining our program. Your travel insurance should include (without limitation) cover against COVID-19, personal accident, death, medical expenses, and emergency repatriation. We also strongly recommend your insurance covers cancellation, curtailment, personal liability loss of luggage, and personal effects.


You acknowledge that participation may involve inherent risks, including personal injury or property damage, and you assume full responsibility for these risks.

 

Venue

You agree to be held liable for any damage to the Venue outside of what is considered "normal wear and tear." Any aesthetic, electrical, structural, or mechanical damages caused by the participant, participant's affiliate, or invited staff will be the sole responsibility of the participant to pay, in full, to the Venue. Damages will be assessed by an independent contractor appointed by the Venue and participants agree to pay the amount quoted by the contractor for any repairs.

The Zenera is not liable for any damages to the Venue caused by participants.

 

Release and Indemnity


Participant agrees to release discharge unconditionally and agree not to sue each of Us, our employees, vendors, representatives, and collaborators (collectively and severally referred to as the “Indemnified”), in respect of any loss, liability, claim or cause of action that may arise as a result of, or in connection with, any act, omission, default, failure or error on the part of the Indemnified occurring wholly or partially during the program.

You agree to indemnify and keep indemnified the Indemnified from any loss, liability, claim or cause of action that may be brought against the Indemnified as a result of or in connection with any act, omission, default, failure, or error on the part of the Indemnified occurring wholly or partially during the program.

In the event of any injury or your death caused wholly or partially as a result of or in connection with any act, omission, default, failure, or error on the part of the Indemnified occurring wholly or partially during the event, you agree that your estate and your representatives, executors or administrators indemnify and will keep indemnified the Indemnified from any loss, liability, claim or cause of action that may be brought against the Indemnified by your representatives, executors, administrators, dependants or any other person entitled to claim damages in respect of your death.

To the fullest extent permitted by law any claim by you against the Indemnified is excluded to the extent that it is for indirect or consequential loss, loss of profits, or economic loss, however it arises, or for indirect, special, punitive, or exemplary damages.

 

Participant hereby waives any and all rights to any legal claims or actions against The Zenera and releases and discharges Host and Host's heirs, assigns, successors, officers, employees, agents, executors, partners, administrators or any other legal representatives along with anyone claiming through them (hereinafter, collectively, the "Released Parties"), in their individual capacity or in their business capacities, of all claims, causes of actions, liabilities, disputes, demands, damages, agreements, contracts, obligations, promises, debts, and/or accounts of any kind or any nature, whether currently known or unknown, for any damage, loss, or injury of or relating to the rental of the Venue, which Renter has or ever had or may have in the future against Host or any of the Released Parties.


Severability Clause

If any part of this clause is found invalid, the remainder shall continue to apply.

Participant Agreement and Release Content


Participant hereby waive any ownership and publication rights to event Content created by The Zenera. Participants agree they have no right to sell, license or publish any of the Content to any person or entity.

Participant further releases the Content Creators, their parent company, clients, subsidiaries, affiliates, officers, agents, servants, or employees (“Releases”) from any claims for remuneration associated with any form of damage, foreseen or unforeseen, associated with the proper commercial or artistic use of the Content.

It is the express intent of the Participant that this document shall bind all members of the Participant’s family, heirs, assignees, and personal representatives.

Participants represent that they are 18 years or older.

To protect yourself from unforeseen circumstances, we encourage you to purchase travel insurance.

Content Policy

 

By purchasing The Zenera event ticket the Participant agrees that all photos and videos taken at the event can be used on The Zenera’s official social media and in The Zenera official marketing efforts - if not requested otherwise by the Participant in written form within 72 hours after the event finish date. 

All content (videos, photos) created on The Zenera events by the Participant or The Zenera can be shared on social media on two conditions: 

1) They contain the watermark of The Zenera official logo on the content (has to be visible in all formats)

2) The content description mentions that the photo is taken on The Zenera event with the corresponding tag or mention of The Zenera official page on that channel. 

All content (videos, photos) created on The Zenera events by The Zenera cannot be shared on social media or any other platform for marketing, promotional or sales purposes if not agreed otherwise in written form.

Cancellation and Refund Policy

To reserve a spot, we require an 800 USD non-refundable deposit before the event.

Participants are responsible for booking their own flights or travel routes. We don't refund any travel, flight, or booking costs in case of cancellation.

There will be no refunds or discounts for arriving late, leaving early, flight cancellations, or travel delays.

Referral (affiliate) Program

The Zenera offers an affiliate program ("Program") that allows you to earn commissions by promoting The Zenera programs to your audience.

 

Participation

  • To participate in the Program, you must sign up through our Referral Program Document.

  • For every successful referral of a guest, you will receive a referral commission of 150 USD with an additional Repeat Customer discount of 10% discount for your next The Zenera retreat that can be used within 24 months.

  • All marketing on your side will be on your own, and you are welcome to market our retreats in any way you prefer, especially since you have joined us previously.

  • All commissions will be paid out through Stripe after the completion of the respective retreat.

Program Termination

We reserve the right to terminate your participation in the Program at any time, with or without cause.

Additional Terms

Full terms and conditions for the Program, including commission rates and promotional guidelines, are available upon signing up. These additional terms may be updated from time to time. Continued participation constitutes acceptance of any modifications.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND BY PURCHASING a retreat, I ACCEPT ITS TERMS, AND I AM AWARE THAT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASES.
